⚠️ Important: SafeAlert is a supplemental safety tool. It is NOT a replacement for official emergency services. Always call 199 (NEMA), 767 (Police), or 112 (Emergency) for immediate life-threatening emergencies.
1. Acceptance of Terms
By downloading, installing, or using the SafeAlert mobile application or website ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
These terms constitute a legally binding agreement between you and SafeAlert under the laws of the Federal Republic of Nigeria.
2. Description of Service
SafeAlert provides:
- A mobile application for personal safety and emergency alerting
- Bluetooth connectivity to compatible smart rings for health monitoring
- Real-time location sharing with designated emergency contacts during distress events
- A network of verified community responders who may assist during emergencies
- SMS and WhatsApp notification delivery through third-party providers
- Subscription plans and alert credit systems
3. Eligibility
- You must be at least 13 years of age to use SafeAlert
- If you are under 18, you must have parental or guardian consent
- You must provide accurate and complete information when creating your account
- One account per person — creating multiple accounts is prohibited
4. Emergency Services Disclaimer
SafeAlert is NOT an emergency service provider. We do not guarantee that alerts will be received, that contacts will respond, or that responders will be available. Response times vary and depend on factors outside our control including network connectivity, contact availability, and responder proximity.
You acknowledge that:
- SafeAlert cannot replace government emergency services (Police, NEMA, ambulance)
- Alert delivery depends on internet connectivity and third-party SMS/WhatsApp services
- Heart rate anomaly detection may produce false positives or miss genuine distress events
- SafeAlert responders are community volunteers and their response is not guaranteed
- You remain responsible for your own safety at all times
5. User Responsibilities
- Keep your account credentials and emergency PIN confidential
- Ensure your emergency contacts have consented to receive alerts from you
- Keep your profile information accurate, including medical information and contact details
- Use the SOS function only for genuine emergencies or legitimate testing
- Enable exercise mode when working out to prevent false alerts
- Maintain sufficient alert credits for your protection needs
- Keep the app updated to receive the latest security and feature improvements
6. Prohibited Uses
You must NOT use SafeAlert to:
- Deliberately trigger false emergency alerts
- Harass, stalk, or monitor another person without their consent
- Interfere with legitimate emergency communications
- Reverse engineer, decompile, or attempt to extract our source code
- Create automated scripts or bots that interact with our service
- Resell or commercially exploit the service without written permission
- Violate any applicable Nigerian law or international regulation
7. Subscriptions and Payments
- SafeAlert offers Free, Plus (₦1,500/month or ₦15,000/year), and Family (₦3,500/month) plans
- Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
- Alert credits are consumed when SMS alerts are successfully delivered to contacts
- Credits do not expire and are non-transferable between accounts
- Payments are processed by Google Play (Android) or Apple App Store (iOS) — their payment terms apply
- Refunds are subject to the refund policies of the respective app store
- Prices may change with 30 days notice. Continued use after a price change constitutes acceptance
8. Alert Credits
- 1 alert credit is deducted when an SOS alert results in SMS delivery to your contacts
- Cancelling an alert within the 10-second countdown does not consume credits
- Alerts will fire even if you have zero credits — your safety is never blocked by credit balance
- Credits are consumed at the time of successful delivery, not at the time of triggering
- New accounts receive 3 complimentary starter credits
9. SafeAlert Responder Network
- Responders are verified community volunteers — not SafeAlert employees
- SafeAlert does not guarantee responder availability, response time, or outcomes
- Responders are vetted but SafeAlert does not accept liability for their actions
- By becoming a responder, you agree to respond professionally and in good faith
- SafeAlert reserves the right to remove any responder from the network
10. Intellectual Property
SafeAlert, its logo, interface, algorithms, and content are the exclusive property of SafeAlert and protected by Nigerian copyright law. You may not reproduce, distribute, or create derivative works without written permission.
11. Limitation of Liability
To the maximum extent permitted by Nigerian law, SafeAlert shall not be liable for:
- Any failure to deliver alerts due to network outages, third-party service failures, or device issues
- Physical harm, injury, or death arising from reliance on SafeAlert as a sole safety measure
- Loss of data, unauthorized access, or security breaches beyond our reasonable control
- Indirect, incidental, or consequential damages arising from use of the service
- Actions or omissions of emergency contacts, responders, or security agencies
Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
12. Privacy
Your use of SafeAlert is governed by our Privacy Policy, which is incorporated into these terms by reference.
13. Termination
- You may delete your account at any time through the app Settings
- We may suspend or terminate accounts that violate these terms without prior notice
- Upon termination, your data will be deleted in accordance with our Privacy Policy
- Prepaid credits and subscription time are non-refundable upon termination for cause
14. Changes to Terms
We may update these terms at any time. We will notify you of material changes via the app and email at least 14 days before they take effect. Continued use of SafeAlert after changes constitutes acceptance.
15. Governing Law and Disputes
These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through negotiation in good faith, or if unresolved, through the courts of Nigeria.
